Think Electric Application "A" for Employment or Membership

  1. Basic Eligibility: Provide a photo of my valid electrical license. Provide a photo of my valid drivers license.
  2. Requirements of driving record: No convictions of driving while intoxicated, reckless driving, driving while suspended, speed contest, hit and run, unauthorized use of a motorized vehicle, driving wile under the influence of drugs, aggravated assault with a motor vehicle, driving while in possession of an opened container of an alcoholic beverage, gross negligence (homicide with a motor vehicle), "road rage" and others during the past 72 months.
  3. Transportation & time: My self and my basic tool requirements will arrive on time at job sites or the company shop as required. lateness is not tolerated.
  4. Substance abuse; Employees pledge to work sober and well rested at all times. A request for a alcohol and or drug test may be required at any time. Employees will be terminated from employment if employees refuse to take the test immediately. Employees may be ineligible to work until the results are reviewed. Think Electric may require urine, breath or blood testing for alcohol, controlled substances, over the counter and prescription drugs. I give my permission to any doctor, nurse, technician or medical clinic which may administer the tests or examinations to release the results of any tests or examinations to Think Electric. I agree to release and hold harmless Think Electric, its agents and associates from any and all liability and damages resulting or arising from any medical test or physical examination, or in connection with any action taken by Think Electric in reliance upon the test or examination results, or from the release of the results of any such test or examination. I understand that I may be randomly given a test.
  5. Able to work unattended: Anyone convicted of fraud, sexual assault, sexual harassment, sex abuse, assault with a deadly weapon, grand theft within the past 10 years will not be eligible for employment.
  6. Representative of company: I will represent myself and Think Electric and or its customers in a community minded professional manor at all times.
  7. Information: If I become employed by Think Electric I will turn over to the company any customer or company information in any format that I am not authorized to keep or do not have explicit instructions to maintain related to a customer or Think Electric. I will in no way allow others outside the company to obtain said information. I assume all liability for protecting the personal information, data, material, patent or invention designs, or trade secrets of Think Electric and its customers I am privy to or in possession of.
  8. Smoking Is not permitted on company property or on job sites.
  9. Physical Demands The employee must be able to transport ladders, power and hand tools, and electrical equipment, such as fixtures and rolls of wire, to stay in a stationary position for extended periods of time, and to work on ladders and close to the floor; occasionally transport equipment weighing up to 100 pounds. This work requires concentrated mental and visual attention for sustained periods of time. Inability to to meet these physical requirements may result in disqualification. Think Electric may require testing for physical ability. I give my permission to any doctor, nurse, technician or medical clinic which may administer the tests or examinations to release the results of any tests or examinations to Think Electric. I agree to release and hold harmless Think Electric, its agents and associates from any and all liability and damages resulting or arising from any medical test or physical examination, or in connection with any action taken by Think Electric in reliance upon the test or examination results, or from the release of the results of any such test or examination.
  10. Tools required prior to beginning work. ; A complete set of high quality, brand name, durable, electrician grade, working hand tools including at minimum but not limited to;
    • Complete set of electrician grade screw drivers, sizes 0-4, (small-large) square(Robertson), slotted(flat head) and Phillips.
    • Hand socket drivers for 1/4"-1/2".
    • Linesman pliers.
    • Side cutters.
    • Wire strippers.
    • MC cable stripper.
    • Hand drywall saw (for cut in boxes).
    • Multi meter.
    • A File set, including a 1/2" round file.
    • Conduit reamer tool1/2"-1".
    • 25' Foot tape measure.
    • Small magnetic base level.
    • Channel locks.
    • Tin snips.
    • Allen driver set.
    • Utility or wire dressing knife.
    • Head lamp.
    • Gloves.
    • "Ugly's" or equivalent.
    • Current code book.
    • Water proof boots, rain jacket, rain hat, rain pants.
    • Cold weather gear.
    • quality work boots and or shoes.
    • A tool box or bag capable of carrying all your tools.
    • Tool belt
  11. Tools in my possession are my responsibility for theft and safety and maintained by me. I will only use working safe tools.
  12. Misstatements; Any omission or misstatement of any information requested is grounds for disqualification and immediate termination.
  13. Information will be verified; I authorize Think Electric and its designated representatives to investigate my; background, driving record, record(s). I authorize Think Electric to preform a credit check and background check (including my driving and criminal records) at any time. I agree to release and hold harmless Think Electric, its agents and associates from any and all liability and damages resulting or arising from any background or credit check, or in connection with any action taken by Think Electric in reliance upon the check, or from the release of the results of any such check or examination.
  14. Variable Employment: Construction work involves periods of no work. Think Electric does its best to keep Professional Employees employed during such times. Non professional employees are employed "At will" and may be laid off for any reason at any time. Professional employees managing projects agree to finish all active projects prior to terminating employment. If I engage in other employment I will inform Think Electric immediately.
  15. Log of time required: Employees that work alone or carry a professional license will be solely responsible for promptly completing a daily time card each day. The “time card” shall be on the company server. Time will be checked for verification.
  16. Professional Employee Working Alone Clause This section applies to Licensed Electricians, Engineers and Professional Technicians only:
    • Professionals working alone at the customers site must exercise discretion and independent judgment.
    • Customer consent and approval must be documented prior to any work beginning as per Think Electric Policy.
    • When working alone Professionals will be solely responsible for obtaining clear verified customer approval for all hours prior to engaging in working on a project.
    • Service, non bid, and time and material work orders require professionals to first obtain prior customer approval.
    • On bid jobs; extra work, change orders and temporary power work also require prior approval.
    • Should a customer dispute any hours worked, and the professional is found at fault to have failed to obtain a signed work order for the work the professionals agrees to forfeit the time. Failure of professional to obtain prior customer authorization or to accurately understand the scope of work on a work order renders the professional working on their own time outside of the company should the customer dispute the work.
    • Payable Time: Should Think Electric settle a dispute with a customer regarding failure of Professional to obtain prior customer authorization and collect payment from customer Professional will be immediately paid all wages.
    • Incorrect work: Work completed substantially different than laid out, without change approval of the full-time signing supervising electrician or non NEC code compliant is on professionals own time.
  17. Salary clause: This section applies to Licensed Electricians, Engineers and Professional Technicians only:
  18. Purchases: if requested and issued a PO # employees will purchase material for the company as per the purchasing policy.
  19. Work ethic: I intend to work efficiently, effectively, honestly, willingly, and cooperatively in accordance with company procedure and interpretations.
  20. Design Plan and Layout of work Oregon Law 918-282-0015 requires that Electrical Contractors “assure that all electrical work is made by, or under the direct supervision or control of, a continuously employed full-time signing supervising electrician” and OAR 918-282-0170 (b) states generally that a person with a General Journeyman License “shall work under the supervision, direction and control of a general supervising electrician”. In terms of “design, plan and layout” and the NEC the full-time signing supervising electrician by law needs to have the final say on all code matters. Work completed substantially with willful disregard for layout is grounds for termination.
  21. Cite it Write it Oregon Administrative Rules require inspectors to cite the code when issuing correction notices. Dubbed “Cite it, Write it,” the rules reinforce the consistent application of code on constructions sites throughout Oregon. Think Electric has internalized this rule, when discussing matters of code employees will be expected to properly cite the code section. The full-time signing supervising electrician relies on the input and expertise of engineers, designers, electricians, inspectors and other industry experts as well as employees to design and layout work. Code discussion and ideas for improvement from employees are welcome at company meetings or discussed at the shop and should not interfere with or delay the project at hand.
  22. Standardized design requirements Think Electric makes every effort to applly a consistent design plan and layout to all jobs, including requirements above and beyond code. Standardized design requirements contribute to a more predictable work environment for all Think Electric Staff. I understand that I may have to adjust my personal work prefernces infovor of the Think Electric Standards.
  23. Non paid time and services. Personal breaks are those breaks in excess of normal breaks. Personal breaks and lunch are on my own time. I will not engage in excessive personal calls on the clock.
  24. Service Work: I understand that this position involves service and repair work. For safety employees are required to:
    • Have good English speaking skills.
    • Able to communicate calmly and clearly to customers and employees with generally accepted professional manners in stressful situations.
    • To de-energize circuits or appliances with power locked off prior to commencing work other than for testing, unusual conditions.
    • I will call for assistance if I feel unsafe or unfamiliar the work at hand.
    • At no time shall any other employee penalize another employee for requesting backup.
  25. Discrimination: Think Electric does not discriminate based on age, color, gender, gender identity or expression, social class, marital status, national origin, race, ethnicity, sexual orientation, veteran's status, nationality, age. Employee personal ideology's that discriminate based on any of the aforementioned that are an interference to our operations may be grounds for dismissal.
  26. Separation of employment: Upon separation of employment I will:
    • Faithfully complete all necessary paperwork, return all keys.
    • Return all company tools and
    • Cease to use company tools or property, Think Electric business cards, phones, or accounts. I
    • Not discuss any trade secrets or privileged information about Think Electric or Think Electric customers.
  27. Enforcement: Failure of Think Electric enforcement to enforce any provision of these terms shall not be a waiver or relinquishment of its right to such performance in the future nor of the right to enforce any other provisions of these terms. If any provision of these terms is declared by a court of competent jurisdiction to be illegal or in conflict with any law, the validity of the remaining terms and conditions shall not be affected, and the rights and obligations of the parties shall be construed and enforced as if the terms did not contain the particular provision held to be invalid.
  28. Limitation of liability: Think Electric at its expense will indemnify, hold harmless and defend employees in good standing in all matters, suits, claims, or other legal or illegal actions related to Think electric. Employees shall at their expense indemnify, hold harmless and defend Think Electric and its employees from any claims, demands, suits, fines or other actions due to gross negligence theft, fraud or assult by employee. At no time shall a Think Electric employee or former employee represent a customer of Think Electric in a suit in which Think Electric is the defendant. At no time shall a Think Electric employee or former employee discuss internal affairs of Think Electric with outside agents, news or media, or others, without prior consent from Think Electric.
  29. Resolution of disputes: Any dispute between the parties shall be resolved in Eugene Oregon in the following order before filing a claim or any legal remedy is pursued:
    • Mediated by a staff member not a party to the dispute.
    • Dispute will be mediated by Think Electric legal council.
    • Binding arbitration in Eugene Oregon.
I have read and understand and agree to these terms and conditions as stated above. I am able and willing to fulfill these and my specific job description duty's in exchange for the compensation specified. I understand that should I be hired for this position this will constitute a contract with Think Electric. I understand that this contract alone is not a job offer.
